GENERAL RULES AND REGULATIONS

These General Rules and Regulations of Shopping and Entertainment Centre AKROPOLIS were developed by TAIKOS TURTAS UAB and apply to the Visitors of the Shopping Centre, companies, institutions and organisations, initiative groups of citizens and other entities planning to carry out any activities and/or organise events at the Shopping Centre, at the approaches to the Shopping Centre or in any other place on the site of the Shopping Centre. The application of these Rules and Regulations at the Shopping Centre is based on the right of TAIKOS TURTAS UAB as the owner of the Shopping Centre to administer the property owned by it, to manage and dispose of it at its discretion, and TAIKOS TURTAS UAB has the duty to ensure public order, the security of the Visitors and employees of the Shopping Centre as well as the lawful interests of the persons who carry out economic-commercial activities at the Shopping Centre.
1. DEFINITIONS
1.1. Shopping Centre means the shopping and entertainment Centre AKROPOLIS located at Taikos pr. 61, Klaipėda. Unless otherwise provided by the Rules and Regulations, the definition of the Shopping Centre shall include all buildings, outdoor areas as well as the whole territory of the site(s) of the Shopping Centre. The Shopping Centre can, in essence, hereinafter also be understood as a building or as an economic entity represented by the owner of the Shopping Centre TAIKOS TURTAS UAB and/or AKROPOLIS GROUP UAB providing the Shopping Centre’s development services.
1.2. Site of the Shopping Centre means the site(s) where the Shopping Centre, its parking lots and entrances are located and which is (are) owned or is (are) otherwise managed by TAIKOS TURTAS UAB.
1.3. Administration of the Shopping Centre means the director of TAIKOS TURTAS UAB, the director of AKROPOLIS GROUP UAB providing the Shopping Centre’s development services, the manager of the Shopping Centre and/or other authorised administration employees of the Shopping Centre.
1.4. Employees of the Shopping Centre mean the persons during their working hours at the Shopping Centre who are full-time employees at the Shopping Centre, who work under employment and/or services contracts concluded with the owner of the Shopping Centre and/or the persons who carry out lawful economic-commercial activities at the Shopping Centre. These Rules shall apply to the Employees of the Shopping Centre to the extent their rights and obligations are not otherwise defined by the House Rules of the Shopping Centre and individual instructions of the Administration of the Shopping Centre or agreements with the Shopping Centre.
1.5. Rules and Regulations mean these General Rules and Regulations of the Shopping Centre.
1.6. Visitor(s) mean(s) any person (including the Employee of the Shopping Centre outside his/her working hours) who is present at the Shopping Centre (including the approaches to the Shopping Centre and the Site of the Shopping Centre), as well as companies, institutions, organisations, initiative groups of citizens or other persons and other subjects who are planning to carry out any activities at the Shopping Centre, including the approaches to the Shopping Centre and the boundaries of the Site of the Shopping Centre.
1.7. Event means any event, promotion, meeting, campaign (advertising, political, public, etc.) or any other organised or unorganised event, which pursues certain objectives and which is held at the Shopping Centre, at the approaches to it or on the Site of the Shopping Centre.
1.8. Pet means a domestic dog and/or cat, vaccinated in accordance with the procedure established by law, owned by or otherwise lawfully in the care of a Visitor of the Shopping Centre.
2. GENERAL PROVISIONS
2.1. The present Rules and Regulations govern the principles and conditions of conduct of the Visitors of the Shopping Centre at the Shopping Centre, their rights and obligations.
2.2. Vehicles shall be parked in the parking lots of the Shopping Centre pursuant to the requirements and limitations of the signs installed in the parking lots. The traffic and parking of vehicles shall comply with the road traffic rules.
2.3. The purpose of these Rules and Regulations is to create such rights and obligations of the Visitors of the Shopping Centre and/or the persons planning to carry out their activities at the Shopping Centre which would ensure the maintenance of order and cleanliness at the Shopping Centre, the security of the Visitors and the Employees of the Shopping Centre, public order and would not violate the lawful interests of the Shopping Centre and the Visitors of the Shopping Centre as well as the Employees of the Shopping Centre.
3. RIGHTS AND OBLIGATIONS OF VISITORS
3.1. The Shopping Centre is open for the Visitors from 8 a.m. to 11 p.m. Individual entities providing services to the Visitors at the Shopping Centre may be open for the Visitors for longer or shorter hours if it is coordinated with the Administration of the Shopping Centre. The Administration of the Shopping Centre shall publicly announce the days when the Shopping Centre is closed or works irregular hours. Such information shall be provided in conspicuous locations near the entrances to the Shopping Centre, and also published on the official website of the Shopping Centre.
3.2. The Visitors may only enter and exit the Shopping Centre through the entrances designated for that purpose. It is not allowed for the Visitors to enter the Shopping Centre through staff entrances, technological entrances, and loading and unloading ramps.
3.3. The Visitors shall follow the instructions for the use of equipment located in the Shopping Centre (e.g. escalator).
3.4. The Visitors shall be prohibited from carrying the following items into the Shopping Centre:
• weapons, including cold weapons;
• alcoholic beverages;
• narcotic, psychotropic substances;
• combustible, explosive, toxic, radioactive substances, including other substances which may pose danger to other Visitors, the Employees of the Shopping Centre or the Shopping Centre itself;
• the substances, which are susceptible to staining, have a pungent odour, unless such substances are carried to the seller of such substances operating at the Shopping Centre in order to replace low-quality goods and/or return such substances to their seller in the procedure laid down by legal acts; in that case, the Visitor shall notify the security officers of the Shopping Centre thereof and follow their instructions on the carriage of such substances through the premises of the Shopping Centre.
3.5. It is not allowed to carry foodstuffs (products) into the premises of the shops, catering establishments, service-providing companies, and entertainment venues (including the cinema, ice rink, etc.) operating at the Shopping Centre, including the foodstuffs (products) bought in the shops and/or catering establishments operating at the Shopping Centre.
3.6. It is not allowed to enter the Shopping Centre on a bicycle or scooter; they must be left in the places designated for that purpose near the entrances to the Shopping Centre. The Shopping Centre shall not be responsible for the security of the items left in the said places. The Visitors shall not be rollerblading, skateboarding or using other similar means of transport inside the Shopping Centre.
3.7. While at the Shopping Centre, the Visitors shall not:
• smoke, except for the places designated for that purpose near the entrances to the Shopping Centre;
• consume alcoholic beverages in other places than catering establishments operating at the Shopping Centre;
• litter or otherwise pollute;
• otherwise disturb public order.
3.8. While at the Shopping Centre, the Visitors shall not without the prior written consent from the Administration of the Shopping Centre:
• use devices causing noise, including but not limited to any sound reproducing devices, musical instruments;
• perform or retransmit in any form, otherwise display, render and present artistic works;
• organise and/or hold any Events;
• organise any promotional or campaigning activities, including but not limited to the distribution of leaflets, flyers, dissemination of visual and audio information, public demonstration of advertising stands, signatures' campaigns, etc.;
• photograph and film or otherwise capture video or audio material for commercial purposes;
• leave a car in the parking lot of the Shopping Centre for a period longer than 24 (twenty-four) hours (unless traffic signs provide for a shorter parking duration).
3.9. The Visitors shall follow the instructions of the Administration of the Shopping Centre and security officers. The Visitors who violate the provisions of the legal acts of the Republic of Lithuania or the provisions of these Rules and Regulations may, pursuant to the provisions of the Law on Security of Person and Property, be taken from the Shopping Centre (including the approaches to the Shopping Centre and the Site of the Shopping Centre) and/or prohibited from entering. The security officers of the Shopping Centre shall be entitled to remove the property of the Visitors from the Shopping Centre and/or the Site of the Shopping Centre if it poses a threat to other Visitors or is used/kept in violation of the requirements of legal acts and/or these Rules and Regulations as well as exercise other rights established by legal acts.
4. VISITING WITH PETS
4.1. The Shopping Centre is friendly to Pets (dogs and cats). Visitors may visit the Shopping Centre premises and/or territory with their Pets in accordance with the rules set out in this section below. Only Visitors over the age of 16 years may take/bring a Pet to the Shopping Centre. If there is any doubt that a Visitor is under 16 years of age, the Shopping Centre’s representatives, including security staff, may require proof of identity to verify the Visitor’s age.
4.2. Visitors with Pets are allowed to the common areas of the Shopping Centre and the individual points of sale of goods and/or services marked with a special access permission sign. If a particular point of sale of goods and/or services has imposed additional or different restrictions on the Pet, the Visitors must comply with them.
4.3. Within the premises and territory of the Shopping Centre, the Pet (dog or cat) must be leashed or carried in an animal carrier/bag. A muzzle is mandatory for dangerous and fighting dogs and their crossbreeds (as defined by law), as well as at the Visitor’s responsible assessment of the behaviour and manner of the Pet.
4.4. The Pet must not pose a threat to other Visitors of the Shopping Centre and their Pets. The leash of the Pet (dog or cat) must be shortened up to 1 metre or less so as not to pose a threat to both humans and animals and so that others feel safe.
4.5. The Visitor taking the Pet to the Shopping Centre premises and/or walking with the Pet in the territory of the Shopping Centre must have the necessary means and, if the Pet pollutes, must immediately collect and clean up excrement, urine and/or other contaminants. When walking their Pets in the territory of the Shopping Centre, the Visitors must not allow their Pets to urinate on buildings, temporary structures, flowerpots, sculptures/artwork, defecate or urinate in flowerbeds.
4.6. The Visitors are not allowed to walk their Pets or allow their Pets to go to the playground installed in the Shopping Centre.
4.7. Noise from the Pets accompanying the Visitors to the Shopping Centre must not exceed the established hygiene standards.
4.8. The use of lifts for the transport of Pets is only permitted if there is no objection from other persons in the lift and/or in the vicinity. Transportation of Pets by using escalators/travelators is only permitted while holding the Pet in your arms and if there is no object from other persons in the vicinity.
4.9. The Visitor who has arrived at the Shopping Centre with the Pet (including those who leave the Pet in a designated area at the entrance of the Shopping Centre) shall be responsible for the Pet’s care, behaviour and any damage caused to the Shopping Centre and/or to third parties. It is forbidden to leave the Pet unattended in the Shopping Centre premises, except in specially designated and marked areas.
4.10. The Visitors who do not comply with these rules, including if their Pet is aggressive, undisciplined and/or causes a feeling of insecurity to others, may, in accordance with the provisions of the Law on the Safety of Persons and Property, be escorted out of and/or refused access to the Shopping Centre (including the Shopping Centre accesses and the territory of the landplot of the Shopping Centre).
5. ORGANISATION OF EVENTS
5.1. All and any Events (including meetings under the Law on Meetings of the Republic of Lithuania) may be held at the Shopping Centre, the approaches to it or on the Site of the Shopping Centre upon receipt of the prior written consent from the Administration of the Shopping Centre only.
5.2. The prior written consent of the Administration of the Shopping Centre is based on the duty of the owner of the Shopping Centre and/or the manager of the Shopping Centre to ensure public order as well as the lawful interests of the Visitors, the Employees of the Shopping Centre and/or the persons carrying out economic-commercial activities at the Shopping Centre.
5.3. A person or persons willing to organise the Event shall contact the Administration of the Shopping Centre with a written request at least 5 (five) working days in advance. The request shall specify the following:
• Event organiser(s) - name, surname, address, telephone, other contact information;
• Event date, time;
• Desired place of the Event;
• Type of the Event;
• Purpose of the Event;
• Expected number of participants in the Event.
5.4. When considering the request for the organisation of the Event, the Administration of the Shopping Centre shall take all important circumstances relating to the Event into account and consider their influence on the lawful interests of the Shopping Centre, the Visitors, the Employees of the Shopping Centre and/or the persons carrying out economic-commercial activities at the Shopping Centre. When considering the request, the Administration of the Shopping Centre shall pay special attention to the presence of armed security officers protecting the Shopping Centre, the influence of the Event on the traffic of motor vehicles in the area of the Shopping Centre and the assurance of security of work of the cash collectors providing services to the persons who carry out economic-commercial activities at the Shopping Centre.
5.5. After examining the request, the Administration of the Shopping Centre shall have a right to request the submission of additional information and/or guarantees concerning:
• the security of the Event ensuring public order and the security of the participants of the Event, the Shopping Centre, its Visitors and the Employees of the Shopping Centre;
• the clean-up of the place of the Event after the Event is over;
• mandatory presence of a doctor, ambulance, fire brigade or other specialists in the venue of the Event;
• the changes in the traffic of motor vehicles during the Event, the setting up of the required traffic detours and/or additional traffic signs.
5.6. Even with the written consent of the Administration of the Shopping Centre concerning the organisation of the Event, the organisers of the Event shall in all cases be fully liable for the damage caused to the Shopping Centre, the Visitors, the Employees of the Shopping Centre and/or the persons who carry out economic-commercial activities at the Shopping Centre, their property during the Event and/or their violated rights and any damage resulting therefrom.
6. FINAL PROVISIONS
6.1. These Rules and Regulations shall be binding to all the Visitors of the Shopping Centre. Exceptions to the Rules and Regulations may only be made upon the prior consent of the Administration of the Shopping Centre.
6.2. In cases where the consent of the Administration of the Shopping Centre is required under the provisions of these Rules and Regulations, the interested person shall contact the Administration of the Shopping Centre and submit the request in advance.
6.3. In order to ensure the well-being of the Visitors, the Employees of the Shopping Centre and/or the persons carrying out economic-commercial activities at the Shopping Centre, the Administration of the Shopping Centre shall be entitled to amend the Rules and Regulations, improve them and notify the interested persons thereof by presenting the Rules and Regulations or their principal provisions in conspicuous locations, on the website of the Shopping Centre, and providing a full text of the Rules and Regulations when requested by the interested persons.
6.4. The Rules and Regulations shall take effect from their approval by TAIKOS TURTAS UAB director's order and shall remain in force until they are amended or revoked by TAIKOS TURTAS UAB.
